1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Roleplay Project game server, the website located at this domain, the User Control Panel ("UCP"), and all related services (collectively, the "Service"). The Service is operated by Phytoventures Ltd, a company registered in England and Wales.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. If you are under 18, you are not permitted to register an account or use the Service.

3. Account Registration and Security

To access certain features of the Service, you must register an account. You agree to:

• Provide accurate and complete registration information;
• Maintain the security and confidentiality of your account credentials;
• Accept full responsibility for all activity that occurs under your account;
• Notify us immediately of any unauthorised use of your account.

Phytoventures Ltd shall not be liable for any loss or damage arising from your failure to comply with the above obligations. We reserve the right to suspend or terminate accounts at our sole discretion.

4. Acceptable Use

When using the Service, you agree not to:

• Violate any applicable law or regulation;
• Harass, abuse, threaten, or discriminate against any other user;
• Use cheats, hacks, exploits, automation software, bots, or any other unauthorised third-party software;
• Attempt to gain unauthorised access to the Service, other accounts, or any related systems or networks;
• Interfere with or disrupt the integrity or performance of the Service;
• Engage in real-money trading (RMT) of in-game items, currency, accounts, or any virtual assets;
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity;
• Upload, transmit, or distribute any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable;
• Collect or harvest any personal data of other users without their consent.

Violation of these terms may result in immediate suspension or permanent termination of your account, without notice or refund.

5. Virtual Items and Currency

The Service may contain virtual items, currency, and other in-game assets ("Virtual Items"). You acknowledge and agree that:

• Virtual Items have no real-world monetary value;
• Virtual Items are licensed to you, not sold, and remain the property of Phytoventures Ltd;
• Phytoventures Ltd may modify, remove, or reset Virtual Items at any time without notice or compensation;
• You have no right to transfer, sell, or exchange Virtual Items outside of the Service;
• Phytoventures Ltd bears no liability for any loss of Virtual Items, howsoever caused.

6. User Content

You may submit, upload, or transmit content through the Service, including but not limited to character names, descriptions, messages, and forum posts ("User Content"). You retain ownership of your User Content but grant Phytoventures Ltd a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, publish, and display such User Content in connection with the Service.

You are solely responsible for your User Content. Phytoventures Ltd does not endorse, verify, or guarantee the accuracy of any User Content and shall not be liable for any User Content posted by users.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to software, code, scripts, designs, graphics, text, logos, and trademarks, are the exclusive property of Phytoventures Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.

The Service utilises the RAGE Multiplayer platform and Grand Theft Auto V, which are the property of their respective owners. Phytoventures Ltd is not affiliated with, endorsed by, or associated with Rockstar Games, Take-Two Interactive, or the RAGE:MP development team.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by applicable law, Phytoventures Ltd expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the Service will be uninterrupted, timely, secure, or error-free;
• Any warranty regarding the accuracy, reliability, or completeness of any content or information provided through the Service;
• Any warranty that defects will be corrected or that the Service or its servers are free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHYTOVENTURES LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, use, goodwill, or other intangible losses;
• Damages arising from your access to, use of, or inability to access or use the Service;
• Damages arising from any conduct or content of any third party on the Service;
• Damages arising from unauthorised access, use, or alteration of your transmissions or content;
• Any damages arising from the loss, corruption, or unavailability of Virtual Items, game data, account information, or any other data.

In no event shall the total aggregate liability of Phytoventures Ltd for all claims arising out of or relating to the Service exceed the amount of ten pounds sterling (GBP 10.00). This limitation applies regardless of the legal theory on which the claim is based, including negligence.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Phytoventures Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any rights of a third party;
• Your User Content.

11. Service Availability and Modifications

Phytoventures Ltd reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may perform scheduled or unscheduled maintenance that may result in temporary disruptions. We are under no obligation to maintain, support, upgrade, or update the Service.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Upon termination, all licences and rights granted to you under these Terms will immediately terminate.

Sections relating to intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive any termination of these Terms.

13. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, both parties agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue formal proceedings.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on this page. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Phytoventures Ltd regarding the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
